| In the name of God Amen. I, Richard
Benson, of Anne Arundel County in the State of Maryland, farmer,
being in perfect health of body, and of sound and disposing mind,
memory and understanding - considering the certainty of death, and
the uncertainty of the time thereof, and being desirous to settle my
worldly affairs, and thereby be the better prepared to leave this
world when it shall please God to call me hence dd therefore make
and publish this my last will and Testament in manner and form
following. That is to Say - First and principally I commit my soul
into the hands of almighty God, and my body to the earth, to be
decently buried at the discretion of my Executor hereinafter named
and after my debts and funeral charges are paid I devise and
bequeath as follows - I give and devise unto my two sons John and
Samuel Benson all my rights, title and interest in and to all that
tract of land called addition to Timberridge to be equally divided
between them, to them the said John and Samuel Benson and their
heirs and assigns forever, also I give unto my said son John Benson
one negro Boy named Charles and one negro girl named Hagar to him
and his heirs, until the said Charles and Hager arrived at the age
of thirty five years who are then to be free and emancipate. Also I
give and bequeath unto my said Samuel Benson, one negro boy named
Peter and one negro girl named Sue, to him and his heirs until the
said negroes are to be free and emancipate. Also I give unto my said
sons John and Samuel Benson one negro boy named Anthony to them and
their heirs until said Anthony shall arrive at thirty five years at
which age said negro is to be free and emancipate.
ITEM: I give and devise unto my son Richard Benson all my right title and interest in and to all that tract or parcel of land called Aldridge's Delight, to him the said Richard Benson and his heirs and assigns forever. ITEM: I give and bequeath unto my son Thomas Benson two hundred dollars current money of the State one hundred of which is to be paid by my son Richard Benson - fifty dollars by my son John Benson and the residue fifty dollars by my son Samuel Benson. Also I give unto my son Thomas Benson one feather bed of which he is to have choice also my best horse which is all I give my son Thomas Benson of my Estate. ITEM: I give and bequeath unto my daughter Rachel Yealdhall fifty five dollars which is all I give my said daughter Yealdhall of my Estate. ITEM: I give and bequeath unto my daughter Margaret Sanks fifty five dollars which is all I give my said daughter Sanks of my Estate. ITEM: I give and bequeath unto my two grandsons Benson Stewart and Richard Stewart sons of my daughter Elizabeth Stewart fifty five dollars to be divided equally between them. ITEM: I give and bequeath unto my daughter Ann Forrest fifty five dollars which is all I give my said daughter Forrest of my Estate. ITEM: It is my will and desire that my negro woman Sue shall be free at my death. ITEM: I give and bequeath all the remainder and residue of my Estate to be equally divided between my three sons Richard Benson, John Benson, and Samuel Benson to them their heirs and assigns forever in equal proportion - Share and Share alike and lastly I do hereby constitute and appoint my son Richard Benson sole Executor of this my Last Will and Testament revoking and annulling all former wills by me heretofore made ratifying and confirming this and none other to be my last will and testament. In Testimony whereof I have hereunto set my hand and affixed my seal this Eleventh day of April in the year of our Lord One Thousand Eight Hundred and Twenty. The above will will was probated in Anne Arundel County, on 15 January 1823 by Francis Osborn, Ezekiel Stewart of David, Joshua Osborn, and John Osborn. |
